No speed limit still comes with rules
There is no speed limit on these stretches, but there is a recommended speed. The Autobahn-Richtgeschwindigkeits-Verordnung of 1978 sets it at 130 km/h for cars and vehicles up to 3.5 t, and it applies only in favourable road, traffic, visibility and weather conditions. Driving faster than that is not an offence in itself and carries no fine and no points.
After a crash it counts. If an accident caused by someone else would have been avoided at 130 km/h, a driver who was going faster can be held liable for at least 20% of the damage. The recommendation carries no penalty, but it does carry liability.
The duty to match your speed to the conditions never lifts. § 3 Abs. 1 StVO requires speed to be adapted to the road, the traffic, the visibility and the weather, and to be low enough to stop within the stretch of road you can see. Where fog, snow or rain cut visibility below 50 m, 50 km/h is the limit whatever the signs say.
